Private Law Jurist

As a private law jurist, you are the right hand of project managers in spatial projects. You draw up the necessary agreements and provide substantive advice on area developments. You work together with a fellow private law jurist and are each other's sparring partners. Together you work on the development of project control and legal issues. Furthermore, you work closely with project controllers and risk and planning managers.

You keep a close eye on jurisprudence and other developments in the field and translate these into practice.

Purpose of the assignment. A government organization is looking for an independent private law jurist who delivers legal advisory products and contract documentation for several specific area development projects.

Desired result.

  • An updated model for the letter of intent and anterior agreement (AOK), including legal justification and implementation advice.
  • Legally reviewed and/or drafted agreements for the designated area development projects.
  • An advisory report regarding the tender for a framework agreement for legal advice.
  • Legal advice and risk analyses for previously designated project issues.
  • Correctly handled notarial processes for the designated real estate and area development files.

Activities. The contractor:

  • Analyzes and assesses private law issues within the designated projects.
  • Independently drafts agreements and negotiates legal provisions where necessary.
  • Develops proposals for further development of the model letter of intent and AOK.
  • Conducts legal research into the tendering possibilities for a framework agreement for legal advice.
  • Delivers written legal advice, memos, and risk analyses.
  • Guides the legal and notarial settlement of agreed transactions.
  • Drafting and reviewing contract documents in the context of area development, such as: Letters of intent and anterior agreements, cooperation agreements, project agreements, development agreements, agreements regarding purchase-lease-loan-exchange and establishment of real rights.
  • Legal advice to project managers and project leaders in the context of area development.
  • Further development of the new model letter of intent and AOK.
  • Research into tendering for a framework agreement for legal advice.
  • Point of contact for private law across the department.
  • Arranging and reviewing the notarial settlement of the agreements.

Profile

As a private law jurist, you are the right hand of project managers in spatial projects. You draw up the necessary agreements, provide substantive legal advice on area developments, and translate jurisprudence and professional developments into practice. You work together with a fellow private law jurist and with project controllers and risk and planning managers. You independently determine your working method, planning, and legal approach to achieve the agreed results.

Coordination takes place regarding progress, project frameworks, and deliverables. You do not receive hierarchical guidance.

What they ask

  • Demonstrably completed university degree in Dutch Law.
  • Minimum 3 years of demonstrable work experience in the past 5 years as a private law jurist within area development, real estate development, or land affairs.
  • Minimum 3 years of demonstrable work experience with independently drafting and reviewing anterior agreements, cooperation agreements, and development agreements.
  • Demonstrable work experience as a private law jurist in area development projects in a government organization with at least 50,000+ inhabitants.
  • Candidate demonstrates, through 1 concrete reference project, having independently delivered legal products and advice within complex area developments.

Wishes.

  • Demonstrable work experience with drafting anterior agreements and contract management.
  • Demonstrable knowledge of the Environmental Act (Omgevingswet) and the practical application of policy instruments.
  • Personal motivation and why the candidate is suitable for this assignment (the motivation must be written by the candidate themselves).
  • Minimum 5 years of demonstrable work experience as a private law jurist within area development, real estate development or land affairs.
  • A demonstrable completed university degree at a minimum of university level with a specialization in private law.
