GENERAL TERMS AND CONDITIONS - JOBCOACH & BUDGETCOACH

1. Preamble

1.1 Scope

These Terms and Conditions (hereinafter: "Terms") apply to the product "Custom Application" and all related services offered by IKONS BV with VAT number BE0783643303 (hereinafter: "Provider") via the ikonsfreelance.io platform and related applications.

1.2 Acceptance

By purchasing a Custom Application report or using the product, the User unequivocally agrees to these Terms in their entirety, without any reservation.

By creating an account, regardless of subscription type, the User accepts that IKONS sends matching assignments by email based on the profile created by the User. These communications are functional and inherent to the core of the service (Article 6.1.b GDPR) and are not considered advertising within the meaning of Article XII.13 of the Belgian Code of Economic Law.

2. Definitions

2.1 Definitions

For the purposes of these Terms, the following definitions apply:

  • Service: The product "Custom Application" and all related digital functionalities offered by the Provider.
  • Report: The document generated by automated systems and/or artificial intelligence containing information, analyses and recommendations to support the User's job application.
  • Vacancy Feed: The collection of assignments, vacancies and opportunities displayed via the platform.
  • User: Any natural person or legal entity using the Service.
  • Content: All information, data, texts, images, audiovisual materials and other digital content made available through the Service.
  • Account: Individualized digital access to the Service obtained through registration.

3. Terms of Use

3.1 Eligibility

The User declares that they:

  • Be of legal age (at least 18 years old).
  • Have the legal capacity to enter into contracts.
  • Bear full responsibility for all activities carried out under their Account.

3.2 User Obligations

The User undertakes to:

  • Pursue only lawful purposes.
  • Not infringe any intellectual property rights.
  • Not introduce harmful or malicious code.
  • Not distribute unlawful, defamatory or discriminatory content.
  • Not automatically or at scale extract, copy or resell generated Reports.

4. Account Management

4.1 Registration

When registering, the User guarantees that they will:

  • Provide complete, correct and up-to-date personal data.
  • Maintain the confidentiality of login credentials.
  • Promptly report any unauthorized use of the Account.

4.2 Account Termination

The Provider reserves the right to:

  • Suspend or terminate Accounts without prior notice.
  • Sanction repeated or serious breaches of the Terms.

5. Intellectual Property Rights

5.1 Reservation of Rights

All intellectual property rights relating to the Service, underlying software, architecture, the Vacancy Feed and the structure and layout of the Reports belong exclusively to the Provider.

5.2 License of Use

For a purchased Report, the User obtains a non-exclusive, non-transferable, revocable license for personal use in connection with their own job application. The contents of the Report may be used by the User for the purpose for which it was purchased.

5.3 Restrictions of Use

The User is expressly prohibited from:

  • Automatically reproduce, distribute or commercially exploit the Vacancy Feed or Reports.
  • Perform reverse engineering on the underlying systems or AI models.
  • Use trademarks or logos without explicit written permission.

6. Financial Provisions

6.1 Pay-Per-Use Purchase

The Service is offered on the basis of individual purchases. For each generated Report, the User owes a fixed fee as displayed on the platform at the time of purchase. There is no subscription, automatic renewal or recurring billing.

6.2 Payment Obligations

The fee for a Report is due at the time of purchase. The Report is generated and made available after payment has been received. The User must make payment in accordance with the rates shown on the platform and via the offered payment methods.

6.3 Price Changes

The Provider reserves the right to change the rates per Report. Changes apply only to purchases made after the change and do not affect Reports already purchased.

7. Limitation of Liability

7.1 Disclaimer

The Service is provided on an "as is" basis, without any express or implied warranties.

7.2 Damages

The Provider's liability is at all times limited to:

  • Directly demonstrable damage.
  • Up to the amount paid by the User for the relevant Report.
  • Indirect, incidental and consequential damages are excluded.

7.3 Vacancies, AI Reports and Results

The Provider makes a Vacancy Feed available through the platform containing assignments, vacancies, opportunities and other content that may originate from third parties.

The Provider gives no guarantee regarding the accuracy, completeness, timeliness or availability of assignments, vacancies or other third-party information.

The Provider cannot be held liable for incorrect, incomplete, amended, expired or removed assignments, vacancies or opportunities displayed through the platform, nor for whether an assignment for which a Report was purchased is still available.

The Report is generated in whole or in part by automated systems and/or artificial intelligence (AI) and is provided solely for information and support purposes. The Report may contain recommendations, analyses and summaries that include errors, inaccuracies or outdated information.

The Provider does not guarantee the accuracy, completeness, timeliness or suitability of a Report, and the User acknowledges that they must review and verify the Report themselves before acting upon it.

The User remains at all times solely responsible for the final job application, its contents and the manner in which it is submitted. The application is carried out by the User themselves; the Provider does not apply on behalf of the User and does not act as an intermediary, broker or representative.

Use of the Service and purchase of a Report do not provide any guarantee of obtaining an assignment, client, collaboration, interview, hiring, contract or any other commercial or professional result. Lack of results does not entitle the User to a refund.

8. Right of Withdrawal for Immediate Delivery of Digital Content

A Report constitutes digital content that is generated and delivered immediately after purchase. By proceeding with the purchase, the User expressly agrees that delivery of the digital content begins immediately after purchase and acknowledges that they thereby lose their statutory right of withdrawal, in accordance with applicable EU consumer rights legislation. The User loses the right to withdraw from the agreement as soon as generation and delivery of the Report has started.

9. Payment and Refund Policy

For this product, ikonsfreelance.io operates on the basis of individual purchases per Report. Each purchase is a separate one-time transaction. Because the Report is generated and delivered immediately after payment, no refund is granted for a Report that has already been generated, even if the underlying assignment is no longer available, the application does not lead to a result, or the User does not use the Report or uses it only partially. A refund may only be granted if a technical failure on the Provider's side fully prevented generation or delivery of a paid Report.

10. Access to Vacancies and Reports

The Vacancy Feed can be consulted via the platform. The displayed assignments, vacancies and opportunities are not filtered according to the individual profile or sector of the User and are shown as a general feed. A purchased Report remains available to the User within their Account for as long as the Provider makes it available; the Provider does not guarantee unlimited retention and advises the User to keep their own copy of the Report.

11. Privacy and Data Protection

11.1 Data Processing

Personal data is processed in accordance with applicable privacy legislation and the separately published Privacy Policy.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by Belgian law.

12.2 Competent Courts

All disputes fall under the exclusive jurisdiction of the competent courts of Antwerp.

13. Amendment Clause

13.1 Amendment Authority

The Provider reserves the right to amend the Terms unilaterally, subject to a reasonable notice period. The version of the Terms in force at the time of purchase applies to that purchase.

14. Final Provisions

14.1 Severability Clause

If any provision of these Terms proves to be null or voidable, this does not affect the validity of the remaining provisions.
